These Terms of Service ("Terms") constitute a binding legal agreement between you ("Client", "You", "Merchant") and SC RESERVETY SYSTEMS SRL ("Reservety", "We", "Us"), a company registered in Romania with Registration Number 46083098 / J04/753/2022.
By registering for an account, paying a deposit, or using our platform, you agree to be bound by these Terms. If you are entering into this agreement on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to these Terms.
B2B Service: Reservety is strictly a Business-to-Business (B2B) service. You represent that you are using the Service for professional, commercial purposes and not as a consumer.
Upon payment of your initial fee, Reservety provides a "Concierge Setup" service. We will configure your rental store based on the information provided in your "Launch Kit." This includes inventory data entry, tax configuration, and basic website styling based on our existing templates.
Successful setup requires your timely cooperation. If you fail to provide necessary assets (logos, price lists, banking details) within 30 days of payment, Reservety reserves the right to mark the setup as "Complete" and archive the project. No refunds will be issued for dormant projects caused by Client delays.
Concierge Setup does not include: custom coding, creation of custom features not already present in the platform, logo design, or unlimited design revisions. Requests outside this scope will be quoted separately as Custom Development.
The Service is billed in advance on a monthly or annual basis. Your subscription will automatically renew at the end of each billing cycle unless you cancel at least 24 hours before the renewal date.
All fees are exclusive of taxes, which we will charge as required by law. If you are located in the European Union, VAT (TVA) will be applied unless you provide a valid VAT ID.
30-Day Guarantee: You may request a full refund within 30 days of your initial payment if you are dissatisfied with the service. After 30 days, no refunds will be issued for any reason.
No Refunds on Usage Fees: Fees for third-party services (e.g., Stripe Identity checks, SMS credits, Domain Name registrations) are non-refundable once incurred.
If you initiate a chargeback or payment dispute with your bank, your account will be immediately suspended. We reserve the right to dispute the chargeback and submit evidence of your usage of the Service.
You agree NOT to use Reservety's standard file upload fields to store unencrypted highly sensitive data, specifically full credit card numbers or unmasked medical records.
If you choose to collect raw images of Government IDs or Passports via our file upload features, you acknowledge that you bear full liability as the Data Controller. Reservety strongly recommends using our integrated Stripe Identity feature for secure, compliant verification.
To mitigate liability risks, Reservety reserves the right to automatically permanently delete sensitive file uploads (specifically ID photos) from our servers 90 days after the associated booking has concluded. You are responsible for downloading any data you wish to keep before this period expires. Signed contracts/waivers are retained for the life of the account.
You may not use the Service to rent illegal items, weapons, drug paraphernalia, or any items prohibited by your payment processor (e.g., Stripe/PayPal). Violation of this policy will result in immediate account termination.
For users in the EEA/UK:
Reservety retains all rights to the software platform, code, and design templates. You retain all rights to your specific inventory data, customer lists, and branding assets uploaded to the system.
The Service is provided "AS IS" without warranty of any kind. We do not guarantee that the service will be uninterrupted or error-free.
Liability Cap: To the maximum extent permitted by law, Reservety's total liability for any claim arising out of this agreement shall be limited to the amount you paid to Reservety in the twelve (12) months preceding the incident.
You may cancel your subscription at any time via your dashboard or by emailing support. Upon cancellation, your site will remain active until the end of the current billing period. After this period, your account will be suspended. We reserve the right to delete data from cancelled accounts after 90 days.
These Terms shall be governed by the laws of Romania. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts in Bacau, Romania.
