Understanding Age Restriction

Age restrictions define the minimum age a person must be to rent equipment from your business or to use certain types of rental items. These restrictions come from three sources: law (state statutes that set minimum ages for certain activities), insurance (your policy may exclude coverage for users under a certain age), and company policy (your own risk management decisions).

Legal age restrictions vary by rental type and jurisdiction. Most states require renters to be 18 or older to sign a legally binding contract, which covers most rental agreements. Vehicle and trailer rentals often require the renter to be 21 or older (some companies go to 25 for high-risk vehicles). Boat rentals may have state-specific age requirements for operators. Alcohol-related equipment rentals (like margarita machines) typically require the renter to be 21.

Insurance-driven restrictions are equally important. Your liability insurance policy may exclude coverage for incidents involving users under a certain age. If a 16-year-old operates your trailer and causes an accident, your insurance might deny the claim because the operator was under the policy minimum age. Know your policy terms and set your business restrictions accordingly.

Company policy restrictions go beyond legal and insurance minimums based on your own risk assessment. You might require bounce house supervision by an adult over 18, prohibit unsupervised use by children under a certain age, or set minimum age requirements for operating power tools or motorized equipment.

Enforcing age restrictions requires consistent ID checking. Do not assume age based on appearance. A 17-year-old can look 21, and a 35-year-old can look 25. Check IDs for every rental, no exceptions.

A common mistake is not posting age restrictions clearly on your website and in your booking flow. If a customer shows up to pick up a trailer rental and you turn them away because they are 19 and your minimum is 21, that is a terrible experience. State the age requirement on the product page, in the booking process, and in the confirmation email.

Another mistake is not addressing the use of rental items by minors. Even if the adult renter is of age, their children or guests may use the equipment. Your agreement should specify that the renter is responsible for ensuring all users meet any age or supervision requirements.

Why It Matters

Age restrictions protect your business from legal liability and insurance coverage gaps. Renting to someone under the legal or policy minimum age can invalidate your insurance, violate the law, and expose you to severe liability.

Real-World Example

A jet ski rental company has a firm policy: renters must be 21+ with a valid driver license, and all operators must be 18+ with a boating safety certificate. A 20-year-old customer arrives to rent a jet ski. The staff politely declines, explaining the age policy shown on the website and in the booking confirmation. The customer is disappointed but the company avoids a potential uninsured incident that could cost hundreds of thousands in liability.
